Freedom of Information Ordinance 2002

Large amounts of information are not subject to disclosure under the ordinance, largely undermining the public's right to know. PEMRA
By the late 1990s, Pakistan's establishment realized it needed to counter the cultural threat from Hindi channels available through satellite receivers by encouraging private TV networks, as the state-owned PTV was failing to attract audiences wanting more openness in entertainment and current affairs. This led to the promulgation of an ordinance in 1997 to set up a regulator for electronic media. The Federal Cabinet in January 2002 formally approved an ordinance to create an autonomous regulatory authority for independent electronic media. Initiating in April 2000 as RAMBO (Regulatory Authority for Media Broadcast Organizations), it was later renamed PEMRA (Pakistan Electronic Media Regulatory Authority). PEMRA was established on March 1st, 2002 through an ordinance to induct and facilitate the private sector into electronic media.
PEMRA has been made responsible for formulating technical standards and scrutinizing technical feasibility for broadcasting services including radio, television, satellite broadcasting, cable television, Multi-channel Multi-point Distribution Service (MMDS) and Local Multi-point Distribution Service (LMDS).
According to the PEMRA Ordinance 2002, the Authority has been mandated to:
- Improve the standards of information, education and entertainment.
- Enlarge the choice available to the people of Pakistan in the media.
- Facilitate the devolution of responsibility and power to the grassroots by improving the access of the people to mass media at the local and community level.
- Ensure accountability, transparency and good governance by optimizing the free flow of information.
PEMRA has been formed to provide project management guidelines and action plans to the private sector interested in establishing radio, television and cable TV stations.
The Authority has been empowered to issue licenses for broadcast and CTV stations in the following categories:
- International scale stations
- National scale stations
- Provincial scale stations
- Local Area or Community based stations
- Specific and specialized subject stations
- Cable television network stations
The law lays down stringent and subjective pre-conditions for eligibility of a license. A broadcaster or CTV operator issued a license must guarantee:
- Respect the sovereignty, security and integrity of Pakistan.
- Respect the national, cultural, social and religious values and the principles of public policy as enshrined in the Constitution.
- Ensure that programs and advertisements do not encourage violence, terrorism, racial, ethnic or religious discrimination, sectarianism, extremism, militancy or hatred, or contain pornography or other material offensive to commonly accepted standards of decency.
The ordinance provided for the appointment, by the president, of a chairman who had to be a retired judge of the Supreme Court and six members, including information and communication secretaries and 4 representatives of the public with an acknowledged record of work in radio, television, print media and/or public service.
The Electronic Media Regulatory Authority Ordinance is also considered arbitrary and in violation of international standards for free flow of information, retaining the infamous system of licensing without defining eligibility in unambiguous terms. The obligation imposed on private television channels to telecast programs mandated by the authority appears to be a device to commission them for official propaganda. The ordinance is also silent on the decades-old demand for freeing Pakistan Broadcasting Corporation and Pakistan Television Corporation from official control.
The then government could not institute the regulatory authority initially. After the military coup of 1999, General Musharraf took over as Chief Executive and was favorably disposed to allowing private TV channels, as advisors like Javed Jabbar were ardent supporters of freeing the media.
PEMRA, initially, was placed under the direct control of the Ministry of Information and Broadcasting, raising concerns whether it would function as a neutral regulator or become another means for the Ministry to safeguard state-owned PTV and PBC. However, later, the authority in terms of administrative hierarchy was placed under the Establishment Division. PTV and PBC continue to be outside the regulatory jurisdiction of PEMRA.
PEMRA has been mandated to:

Interestingly, the building where the TV station was first housed was across the road from the Lahore radio station building. Later, when the TV station building was ready, it was again adjacent to the radio station building. This proximity meant that many radio staff members were engaged in TV broadcast, moving between stations multiple times a day, giving TV broadcast a "color" of radio broadcast.
The Staff
Hardly trained staff was available to run a TV station, especially on the programming side. On the technical or ENG side—cameramen, lighting directors, set designers—were available. But to manage programs, TV had to rely on people trained in radio broadcast.
Over time, staff required to operate a TV broadcasting house from all aspects have been trained at the academy set up in the early seventies in Islamabad. This academy also provides training to in-service staff on new experimentation in TV production. Foreign qualified and locally experienced people manage matters at the academy.

News Reading

In the early days of TV, there was hardly any footage of news-related events available. The news reading was a simple replica of radio news with the only difference being that viewers could see the broadcaster—and discuss their face and gestures during reading, making it difficult for viewers to maintain the rapt attention they gave to radio news.

Discussion / Talk Shows
The visualizing of a talk show or discussion program was not different from what radio listeners were familiar with. Since microphones were not available as they are today, one microphone would move from one speaker to another to keep the voice intact for recording.
If another speaker chipped in while the microphone was elsewhere, viewers could see them making observations but could not get the words uttered. Today, one can hear even minute remarks made by a speaker during a discussion, giving more scope to understand what is happening and what others are thinking when a speaker is talking.
Programming
The replica problem was not limited to current affairs shows; the issue was the same with the programming side of TV broadcast.
Dramas
If you listen to the sound-track of an early TV drama, you may feel like listening to a radio drama. The sequence of the play, the dialogue delivery, the diction, and the speech treatment—all had come from radio plays. Mostly, radio drama producers/directors had gotten jobs with TV because no trained people were available who knew electronic media techniques and the use of devices like microphones, amplifiers, consoles, and recording panels.
